شرح شغل:
- تنظیم، بررسی و اصلاح انواع قراردادهای خرید، تأمین تجهیزات و انواع قراردادهای EPC ،PC ،C ،E حوزه نفت و گاز.
- ارائه مشاوره حقوقی به واحدهای مختلف شرکت در زمینه مسائل قراردادی و دعاوی.
- مدیریت و پیگیری دعاوی حقوقی مربوط به قراردادها و مسائل مختلف حقوقی از جمله دعاوی تجاری و کاری و تنظیم مکاتبات قراردادی، پیگیری و دفاع از حقوق شرکت در اداره کار و تهیه و تنظیم لایحه‌های حقوقی به دادخواست‌ها، اظهارنامه‌ها و غیره جهت ارائه به مراجع قانونی و دادگاه‌ها.
- ارائه راه‌حل‌های حقوقی برای حل‌وفصل اختلافات بین طرفین قرارداد و مدیریت ادعاهای احتمالی و یا طرح شده.
- شرکت در مذاکرات حقوقی و قراردادی و تشخیص ریسک‌های قانونی و اجرایی.
- نظارت بر فرآیند شفاف‌سازی و مستندسازی عقد قرارداد.
- ارائه پیشنهادات در قراردادنویسی.
- پیگیری مراجعات و ارتباطات.
- انجام پیگیری‌های لازم مربوط به فسخ و خاتمه قرارداد.
- تهیه و تنظیم پیش‌نویس انواع تفاهم‌نامه‌ها، قراردادها، تعهدنامه‌ها و سایر اسناد تعهدآور و غیرتعهدآور حقوقی.
شرایط احراز:
- مسلط به قوانین حقوقی و قراردادی.
- توانایی نگارش و تنظیم مستندات قانونی با دقت بالا.
- تجربه در حل‌وفصل دعاوی حقوقی به ویژه دعاوی مربوط به قراردادهای پروژه‌های صنعتی.
- توانایی تحلیل و تفسیر قراردادها.
- دانش مفاهیم و نحوه انعقاد قراردادها.
- اطلاع از قوانین حوزه کارفرما.
- آشنایی با امور مالی قراردادها و تضامین.
- مسلط به زبان انگلیسی مخصوصاً در نگارش و سابقه تنظیم قراردادهای خارجی.
- آشنایی نسبی با رویه بررسی صورت‌وضعیت‌ها، صورتجلسات و فرآیندهای حوزه کنترل و رسیدگی قراردادها.
- دارای مدرک وکالت از کانون وکلای دادگستری و فارغ‌التحصیل از دانشگاه‌های معتبر.
